Truck Accidents

Accidents with commercial trucks are very different than your typical car accident
cases. Commercial trucks have to abide by a very specific set of laws and rules.
Collins Law Firm LLC has experience dealing with commercial trucking rules and
regulations and knows how exactly to get the best result for clients injured in
truck accident cases. Truck accident cases require sophisticated representation
with a deep knowledge of the trucking industry – that’s exactly what you’ll get
from Collins Law Firm LLC!

Why Do Truck Accidents Occur? The Top Ten List:
The Federal Motor Carrier Safety Administration (FMCSA), is the governing
agency involved with regulating and monitoring the safety of the commercial
trucking industry. The FMCSA has come with data that shows the top 10
reasons truck accidents occur. The Top 10 reasons are provided below:

  • Brake issues
  • Traffic flow problems (congestion, bottlenecking from other crash)
  • Prescription drug use of truckers
  • Traveling too fast for conditions
  • Unfamiliarity with roadway
  • Roadway problems
  • Required to stop before crash (for stoplight, conditions requiring
    braking)
  • Over-the-counter drug use
  • Poor lookout of the road conditions
  • Driver Fatigue

Car Accidents

Very often, car accidents happen due to someone else's fault or from factors outside your
control.

Incredibly, 40% of accidents are caused by alcohol. Drunk drivers often drive very
recklessly and make an accident unavoidable for you. The results can literally turn your life
upside down for you and your loved ones.

Speeding accounts for 30% of accidents. Too often, other motorists fail to slow down for
driving conditions that warrant slower conditions such as: bad weather, heavy traffic,
construction, lane merging and other potentially hazardous conditions.

Finally, 1 out of every 3 crashes involves reckless driving. We’ve all seen other cars driving
erratically and irresponsibly. If one of these drivers hits you, you will need immediate legal
help to make sure that you are compensated for all your injuries.

As these statistics make clear, car accidents very often happen due to someone else's fault
or from factors outside your control.  If you have been injured by another driver due to them
being at fault and driving dangerously or recklessly, give Collins Law Firm LLC a call. Call or

Medical Malpractice

Mercy Hospital in Springfield, Missouri lost a malpractice trial, in which the jury awarded substantial damages to a patient who has misdiagnosed. As a result, she suffered permanent,
debilitating injuries. The case, appealed to the Missouri Supreme Court, found favorable outcome there, as well.  LINK

Mercy was denied a new trial, and the hospital system will not be able to spread the awarded payments out over decades, as it initially proposed. Instead payment of medical damages periodically over many years was found by the Missouri Supreme Court to be disallowed. This is because that method added another layer of discounting that reduced the value of the award.

Also, these future payments would have come with too low of interest rates LINK

Class Action (Injury)

Monsanto, the St Louis-based chemical company that was recently acquired by Bayer, finds itself confronted with a new class action lawsuit. A lawsuit was filed in a Missouri federal court claiming Monsanto engaged in deceptive labeling practices that don’t properly warn consumers about the health effects of products like Roundup Weed & Grass Killer on the human digestive system. LINK

Consolidating many hundreds (or thousands) of similar individual claim into a single class action filing can be a helpful way of getting justice without having to take the same claims to courts individually over and over again throughout the years.

Employee Protections

Employees expect to be paid the wages that they are promised in employment contracts and
other hiring or employment handbook materials. A recent jury verdict in mid-Missouri drove that
message home, as Missouri prison guards were awarded substantial back pay. LINK

These prison guards had performed tasks that required them to be on-site and on-duty, such as
clearing security screening to report for watch and then again when exiting the prisons. But they
were never properly paid for this time over the course of several years.

Breach of Contract

Verizon must now face the music over allegations that it breached its sales contracts with thousands of its customers. Among other things, its two-year usage agreements with customers for TV, internet and phone service contained undelivered promises. More specifically, verizon promised its customers a host of benefits like Amazon Prime memberships and Echo devices. But it failed to deliver. Now a lawsuit has been filed on behalf of consumers by the Pennsylvania Attorney General claiming that Verizon has breached its user contracts with these many thousands of customers. LINK

Nursing Home Abuse/Negligence

nursing home abuse neglect

Very recently, the family of a St Louis area nursing home resident filed suit in court on behalf of an elderly grandmother. The allegations are beyond startling: the 84 year old resident had bruising suggestive of having been raped. LINK

There are 515 nursing homes in operation in Missouri alone.

Moreover, there are fully 1 million seniors over the age of 65 in Missouri, creating a large demand for these nursing home facilities. It’s estimated that a decade from now, 1 in 5 Missouri residents will be seniors. LINK

While nursing homes are the subject of state laws and regulations, reports of nursing home abuse are on the rise. In fact, there are THOUSANDS of reports of senior abuse in a SINGLE YEAR within the state of Missouri alone.

If you know or suspect that your loved one is the subject of nursing home abuse , you can pursue legal action against the nursing home. You can seek fair compensation for nursing home wrongdoing, including future expenses that result from the past misconduct and negligence.
